1. Overview
Welcome to MLS Church AI DJ ("MLS Church," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our websites, apps, AI DJ features, event pages, content, and services (collectively, the "Services"). By using the Services, you agree to these Terms and to our Privacy Policy.
2. Eligibility & Accounts
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services. When creating an account, you agree to provide accurate information and to keep your credentials secure. You are responsible for all activity under your account.
3. Permitted Use
You may use the Services for lawful, non-commercial purposes related to worship events, community gatherings, music playback/queuing, and related features. You agree not to:
- Violate any law, regulation, or third-party right (including copyright and privacy).
- Upload or share content that is illegal, hateful, harassing, defamatory, obscene, or otherwise harmful.
- Interfere with or disrupt the Services (e.g., scraping, spamming, circumventing security, reverse engineering).
- Impersonate others or misrepresent your affiliation.
4. User Content & License
You retain ownership of content you submit (e.g., playlists, comments, audio inputs). By submitting content, you grant MLS Church a non-exclusive, worldwide, royalty-free license to host, store, reproduce, adapt, display, and distribute your content solely to operate, improve, and promote the Services. You represent that you have the necessary rights and permissions to submit such content.
5. AI & Audio Features
Our AI DJ and transcription/caption features may process audio, text, and metadata to deliver mixes, recommendations, translations, and accessibility overlays. We strive for accuracy but do not guarantee error-free results. Do not rely on AI outputs for sensitive decisions. By enabling microphones or uploading media, you confirm you have obtained any required consents (e.g., from speakers or performers) and that recording is permitted in your jurisdiction and venue.
6. Events, Bookings & Payments
Some Services (e.g., boat worship events, group sessions) may require ticketing or fees handled by us or third-party processors. Prices, taxes, availability, and fees may change. Unless otherwise stated:
- Bookings are confirmed only after successful payment.
- Refunds/cancellations follow the event's posted policy.
- No resale or transfer if prohibited by event terms.
- We may modify or cancel events for safety, weather, or operational reasons; where feasible, we will offer a refund or alternative date as set out in the event policy.
7. Third-Party Services
The Services may integrate third-party platforms (e.g., YouTube, Google, Supabase, Vercel, payment processors, ad networks). Your use of third-party services is governed by their terms and privacy policies. We are not responsible for third-party content or actions.
8. Advertising & Cookies
We may display ads (e.g., Google AdSense). Advertising partners may use cookies or similar technologies to deliver and measure ads. See our Privacy Policy for details and opt-out options available through your browser or regional frameworks.
9. Intellectual Property
All rights in the Services and their design, code, and brand elements (excluding User Content and third-party content) are owned by MLS Church or its licensors and are protected by applicable laws. You may not copy, modify, distribute, or create derivative works without permission.
10. Copyright Complaints (Notice Procedure)
If you believe content on the Services infringes your copyright, send a notice to: jaywhy@mls.church.
Include: (a) your contact info; (b) identification of the copyrighted work; (c) the specific URL(s) of allegedly infringing material; (d) a statement of good-faith belief; (e) a statement that the notice is accurate and you are authorized to act; (f) your signature. We may remove or disable content and, where appropriate, terminate repeat infringers.
11. Privacy
Your use of the Services is subject to our Privacy Policy, which explains what we collect, why we collect it, and how we use, store, and share information. By using the Services, you consent to these practices.
12. Safety & Disclaimers
Worship gatherings, live events, and boat activities involve inherent risks (e.g., weather, motion, sound levels). Follow all instructions from staff and adhere to venue rules. THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted, secure, or error-free operation.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MLS CHURCH AND ITS OFFICERS, DIRECTORS, VOLUNTEERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; OR FOR LOST PROFITS, REVENUES, DATA, OR GOODWILL; ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIMS WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM (OR $100 IF NO PAYMENTS WERE MADE).
14. Indemnification
You agree to defend, indemnify, and hold harmless MLS Church and its affiliates from any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from your use of the Services, your content, or your violation of these Terms or applicable law.
15. Termination
We may suspend or terminate your access to the Services at any time with or without notice for any reason, including suspected violations of these Terms or harm to others. Upon termination, Sections 4–5 and 9–18 survive.
16. Changes to the Services or Terms
We may modify or discontinue parts of the Services and update these Terms. Material changes will be posted with a revised "Last Updated" date. Your continued use after changes means you accept the updated Terms.
17. Governing Law; Venue
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. You agree to the exclusive jurisdiction and venue of the courts located in Toronto, Ontario, Canada.
